Licence Agreement

The short version: it's yours, for as long as you want it, on as many of your own computers as you like. Don't resell it. Look inside it all you want.
This agreement is between you and Talos Group LLC and covers the desktop applications we sell at tools.talos-group.com. Installing one means you accept it.
What you're getting
A licence to use the software, not ownership of the software itself. The licence is per person, not per machine: install it on every computer you personally use, at home and at work, macOS and Windows. If two people are using it, that's two licences.
Commercial use is included at the same price. We're not going to charge a designer more than a hobbyist for the same program.
The licence is perpetual. It doesn't expire, doesn't need renewing, and doesn't phone anything to stay alive.
What this licence doesn't allow
- Redistributing, reselling, or sublicensing the installer or your licence.
- Renting, leasing, or lending it out as a service to others.
- Removing or altering copyright and licence notices.
- Using it to break the law, or to process material you have no right to.
You'll notice there's no device limit here. That's deliberate. There's no licence key and no activation, so a “three machines” rule would be one we could never see broken — and a term nobody can enforce just teaches you that this document says things it doesn't mean.
Looking inside the software is fine
We sell these on a claim you're meant to be able to check: pull your network cable out and the tool still works, because nothing was ever being sent. You are expressly permitted to inspect, test, monitor and verify what the software does — with a packet sniffer, a debugger, or anything else. A clause forbidding that would contradict the entire product.
Please don't decompile it to build a competing product or to strip out the licensing, except where law expressly permits it regardless of what we say here.
Who owns what
We own the software and everything in it that isn't someone else's. You own everything you make with it — your converted photos, your notes, your QR codes. We have no claim on any of it, and no way to see it.
Updates
Each app has a “Check for updates” button. It only runs when you press it. Nothing installs itself, and we do not reserve any right to change the software on your machine without you asking — a security tool that rewrites its own binary unprompted is not a thing we're willing to ship.
Point releases within a major version are free. We're not naming a fixed support period we might not be able to staff; if a future version is a paid upgrade, we'll say so plainly and the version you bought will keep working.
Open-source components
These apps are built on a lot of other people's work. Every component, its version and its licence is listed on the licences page, and inside each app. Those components stay under their own licences — nothing in this agreement overrides them, and where a component's licence gives you rights this one doesn't, that licence wins for that component.
No warranty
THE SOFTWARE IS PROVIDED “AS IS,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
In plainer terms: we've tested these carefully and we stand behind them, but we can't promise any program is free of defects. Keep backups of anything you can't afford to lose. That goes double for Secure Notepad — if you forget your passphrase, the notes are gone, and no one, including us, can recover them. That's the point of it.
Limits on what we owe you
TO THE FULLEST EXTENT PERMITTED BY LAW, TALOS GROUP LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, OR FOR LOST DATA OR LOST PROFITS, ARISING FROM YOUR USE OF THE SOFTWARE. OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNT YOU PAID FOR THE LICENCE.
Nothing here removes rights you have under consumer law that can't be waived by agreement.
Ending this licence
The licence ends if you take a refund, or if you break the terms above. Either way you should stop using the software and delete your copies. We have no technical means of ending it for you, and we're not going to build one.
Export
Don't take the software anywhere US export law says it may not go, and don't supply it to anyone US sanctions prohibit.
Governing law
This agreement is governed by the laws of the State of Indiana, United States, without regard to its conflict-of-laws rules.
